Terms & Conditions
These Terms & Conditions apply to bookings, stays and participation in retreats, accommodation, surfing, yoga and other activities offered under the Sunshine Stories brand.
By confirming a booking, accepting these Terms electronically and/or participating in Sunshine Stories activities, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
1. Bookings, Payments, Changes & Cancellations
A booking is confirmed once the required payment has been received as specified during the booking process or in your booking confirmation.
Prices are charged in the currency stated at the time of booking. Applicable taxes, card charges, bank fees or currency conversion charges may apply where disclosed.
Non-Refundable Bookings
Unless otherwise expressly stated at the time of booking, all Sunshine Stories bookings are non-refundable.
Once a booking has been confirmed, payments made are not refundable if you cancel, shorten your stay, arrive late, depart early or are unable to travel for personal reasons.
We strongly recommend appropriate travel insurance.
Free Date Change
You may request one free change of travel dates up to 90 days before your original check-in date, subject to availability.
The replacement stay must be completed within 12 months of the original check-in date.
If the new booking is more expensive, you must pay the difference. If the new booking is less expensive, the difference will not be refunded.
Date changes requested within 90 days of check-in are not permitted unless otherwise agreed by Sunshine Stories.
Changing your dates does not convert a non-refundable booking into a refundable booking.
All cancellation and date-change requests must be submitted in writing.
Optional Cancellation Protection
Sunshine Stories may offer optional Cancellation Protection for an additional charge.
Where Cancellation Protection has been purchased, cancellation and refund eligibility will be governed by the separate Cancellation Protection Terms presented at the time of purchase.
The Cancellation Protection fee itself is non-refundable unless otherwise stated in the applicable Cancellation Protection Terms.
2. Insurance, Health & Personal Responsibility
Sunshine Stories does not provide personal travel, medical, accident or belongings insurance.
Guests are responsible for obtaining appropriate travel and medical insurance before arrival. Where participating in surfing or other physical activities, your insurance should provide appropriate coverage for those activities.
You are responsible for determining whether you are physically and medically fit to participate in the activities you choose.
You must inform Sunshine Stories of any medical conditions, allergies, injuries, pregnancy or other circumstances that may reasonably affect your safe participation.
Where appropriate, you should seek medical advice before participating in physical activities.
Information provided regarding your health, swimming ability, surfing experience or other matters relevant to safe participation must be accurate and complete.
3. Surfing, Yoga & Other Activities
Participation in surfing, swimming, yoga, fitness, excursions and other activities is voluntary and involves inherent risks.
These risks may include physical exertion and injury, waves, currents, tides, reefs, rocks, surfboards, other surfers, changing ocean and weather conditions, sun, heat, wildlife, transportation and risks ordinarily associated with travel and outdoor activities.
By participating, you acknowledge and voluntarily accept the inherent risks associated with the relevant activity.
Guests must attend applicable safety briefings and follow reasonable instructions provided by Sunshine Stories coaches, instructors and staff.
Surf locations, schedules and activities may change depending on swell, tides, weather, guest ability, crowd levels, safety considerations and other circumstances. Sunshine Stories does not guarantee particular surf conditions, surf locations, weather, waves or individual progression.
Sunshine Stories may change, postpone or cancel an activity where conditions are considered unsuitable or unsafe.
An instructor may refuse or stop a guest's participation where they reasonably consider participation unsafe.
Guests whose coordination, alertness or judgment is materially impaired by alcohol, recreational drugs or medication will not be permitted to participate in activities where doing so may create a safety risk.
4. Emergency & Medical Assistance
In an emergency, Sunshine Stories staff may provide reasonable assistance within the limits of their training and available resources.
You consent to reasonable emergency first aid and, where considered necessary, transportation or referral for professional medical treatment.
Guests are responsible for costs associated with medical treatment, medication, hospitals, ambulances, emergency transportation or other healthcare provided on their behalf.
Where Sunshine Stories reasonably incurs such expenses on your behalf, you agree to reimburse the reasonable amount incurred.
5. Guest Conduct, Accommodation & Property
Guests are expected to behave respectfully towards other guests, staff, local communities and the surrounding environment and to follow reasonable property and safety rules.
Sunshine Stories may refuse participation in an activity or terminate a guest's stay in cases of serious misconduct, illegal activity, abusive or threatening behaviour, repeated material breaches of these Terms or behaviour presenting a material risk to the guest, other guests, staff or property.
Where a stay is terminated for these reasons, the guest may be required to leave the property and no refund will be provided for unused accommodation, activities or services, to the extent permitted by applicable law.
Sunshine Stories property and equipment, including accommodation facilities, surfboards and yoga equipment, must be treated with reasonable care.
Guests may be charged the reasonable cost of repairing or replacing property or equipment damaged or lost through negligence, misuse or failure to follow instructions. Normal wear and tear is excluded.
Guests are responsible for taking reasonable care of their personal belongings. Sunshine Stories is not responsible for loss, theft or damage to personal belongings except where such liability cannot legally be excluded.
6. Changes & Circumstances Beyond Our Control
Sunshine Stories may make reasonable changes to retreat schedules, surf locations, activities, instructors, transportation or other arrangements due to weather, ocean conditions, safety considerations, operational requirements or other circumstances.
Sunshine Stories is not responsible for failure, delay, modification or cancellation caused by circumstances beyond its reasonable control, including severe weather, natural disasters, pandemics or epidemics, government restrictions, civil disturbance, strikes, transportation disruption, utility failures or other extraordinary events.
Where reasonably possible, Sunshine Stories will attempt to provide an alternative or reschedule affected services.
Where Sunshine Stories cancels a material part of your booking and does not provide a reasonable alternative, an appropriate credit, rescheduling option or refund will be provided in accordance with applicable law and the circumstances of the cancellation.
7. Photography, Privacy & Personal Information
Photos and videos may be taken during Sunshine Stories stays and activities and may be used for our website, social media, advertising and other promotional purposes.
Guests who do not wish to appear in identifiable promotional photography or video may opt out during online check-in or notify Sunshine Stories in writing.
Following an opt-out, we will take reasonable steps to avoid intentionally capturing or publishing identifiable images of that guest.
Sunshine Stories may collect personal information reasonably necessary to administer bookings, provide services and protect guest health and safety. This may include contact information, dietary requirements, relevant medical or allergy information, emergency contacts and surfing experience.
Information may be shared with staff, instructors, service providers, medical professionals or relevant authorities where reasonably necessary to provide services, respond to an emergency, comply with legal obligations or protect legitimate interests.
Personal information will be handled in accordance with applicable data protection law.
8. Liability & Assumption of Risk
Sunshine Stories takes reasonable measures to provide its services and activities safely. However, risks associated with travel, ocean activities, physical activity and the natural environment cannot be completely eliminated.
By choosing to participate, you voluntarily assume the inherent risks ordinarily associated with the relevant activity.
To the fullest extent permitted by applicable law, Sunshine Stories and its directors, employees, instructors, contractors and authorised representatives will not be liable for injury, loss, damage, expense or other consequences resulting from inherent risks voluntarily assumed by a guest.
Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.
Guests are responsible for reasonable losses, damage or costs resulting directly from their negligent, reckless or unlawful conduct.
9. Online Check-In & Guest Information
Guests may be required to complete online check-in before arrival and provide information reasonably necessary for their stay and participation in activities.
This may include arrival and departure information, dietary requirements, emergency contact details, relevant medical or allergy information, swimming ability and surfing experience.
Each adult guest may be required to individually acknowledge the activity risks, safety requirements, medical provisions and relevant Terms & Conditions before participating in Sunshine Stories activities.
For guests under 18, the required acknowledgement must be completed by a parent or legal guardian.
Failure to provide information reasonably required for safe participation may result in a guest being unable to participate in an activity.
10. Governing Law & General Terms
These Terms & Conditions and Sunshine Stories services and activities provided in Sri Lanka are governed by the laws of Sri Lanka, subject to any mandatory applicable law.
Disputes arising from Sunshine Stories services or activities provided in Sri Lanka shall, subject to any mandatory applicable law, be subject to the jurisdiction of the courts of Sri Lanka.
Before commencing formal legal proceedings, both parties agree to make reasonable efforts to resolve any dispute through good-faith communication.
These Terms may be accepted electronically. Electronic acceptance, confirmation of a booking and completion of the applicable booking process constitute acceptance of these Terms to the extent permitted by applicable law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
For the purposes of these Terms, “Sunshine Stories”, “we”, “us” and “our” refer to the Sunshine Stories brand and the provider(s) involved in delivering the relevant booking, stay, activity or service.
Acknowledgement
By confirming your booking and/or participating in Sunshine Stories activities, you confirm that you have read and understood these Terms & Conditions, including the provisions concerning bookings and cancellations, insurance, medical responsibility, activity risks, emergency assistance, guest conduct and limitation of liability.
You voluntarily choose to participate in Sunshine Stories activities subject to these Terms & Conditions.
